Terms of service

These Terms of Service (“Terms”) apply when you use designingliefde.com (the “Website”) or buy from Designing Liefde.

Please read them before placing an order. They explain who we are, when we accept an order, and the rights and responsibilities that apply. These Terms do not limit any consumer rights that the law says cannot be limited.

1. About us and how to contact us

Designing Liefde is run by Yvonne Erica Dzhantov, a sole trader trading as Designing Liefde. In these Terms, “we”, “us”, and “our” mean Designing Liefde.

We do not currently have a business telephone line. Please contact us by email and include your order number if your message is about an order.

2. Who may order

Our shop is for consumers buying products for personal use. We currently deliver only to the United Kingdom and the United States.

You must be 18 or over to place an order. If you are under 18, a parent or legal guardian must give permission, supervise the purchase, and accept responsibility for it.

Please contact us before making a wholesale, resale, or other business purchase. These purchases need a separate written agreement.

3. Products

These Terms cover physical stationery and journaling products that are in stock. They do not currently cover personalised, made-to-order, preorder, subscription, or digital products.

We take reasonable care to describe and photograph our products accurately. Screen settings may affect how colours appear, and packaging or other minor details may vary. Measurements are approximate unless we say otherwise. These small differences do not affect your rights if a product is faulty, incorrectly described, or does not meet the contract.

Putting an item in your cart does not reserve it. It remains subject to availability until we accept your order.

4. Prices and taxes

Prices are shown in pounds sterling (GBP), unless the Website or checkout clearly shows another currency.

We are not registered for UK VAT, so we do not charge UK VAT. Product prices do not include delivery where it is charged separately. Delivery costs and any taxes collected at checkout will be shown before you place your order.

Your bank or payment provider may use its own exchange rate or charge currency-conversion fees. We do not control these charges.

We may change prices for future orders. This will not change the price of an order we have already accepted.

If a price or product description has an obvious error, we may contact you before accepting the order. You can continue at the correct price or cancel. If we cannot contact you, or you do not want to continue, we will reject the order and promptly refund any payment taken.

5. Placing an order and when a contract begins

Checkout gives you a chance to review and correct your order. Please check the products, quantities, delivery address, delivery method, and total before submitting it.

When you submit an order, you are offering to buy the products. Shopify’s automatic order acknowledgement only confirms that we received the order. It does not mean that we have accepted it.

We accept your order when we send the dispatch-confirmation email. A binding contract then begins for the products listed in that email.

Before acceptance, we may reject an order for a reasonable reason, such as:

  • a product being unavailable;
  • a failed or unauthorised payment;
  • suspected fraud or unlawful activity;
  • an obvious price or product-information error;
  • delivery not being available to the address provided;
  • a purchase limit being exceeded; or
  • a legal or regulatory restriction.

If we reject an order after taking payment, we will promptly refund the original payment method.

6. Payment

Payment is taken when you submit your order through Shopify Checkout. The available payment methods are shown there.

You confirm that you are allowed to use your chosen payment method and that your billing information is correct. Shopify and other payment providers may process the payment under their own terms and privacy notices.

7. Promotions and discount codes

An offer may have extra terms shown with it. Unless we say otherwise, a discount code:

  • must be entered before checkout is completed;
  • cannot be exchanged for cash;
  • cannot be added after an order is placed; and
  • cannot be combined with another offer.

We may refuse or cancel a discount obtained through fraud, misuse, or an obvious error. We will not otherwise change a valid order more than reasonably necessary.

8. Processing and dispatch

We usually prepare and dispatch orders within 5–7 business days after they are placed. Business days do not include Saturdays, Sundays, or public holidays in England.

Processing may take longer during busy periods or after a new product release. We will contact you if we expect a significant delay. Unless we agree a different timeframe with you, we will deliver without undue delay and within 30 days after the contract begins.

If you need an order by a particular date, contact us before ordering so we can tell you whether that date is possible.

9. Delivery

Current delivery methods, charges, and free-delivery thresholds are shown in our Shipping Policy or at checkout. We may change these details for future orders. We will not change the delivery method or charge for an accepted order without your agreement.

Estimated delivery times after dispatch are:

  • United Kingdom: usually 3–5 business days; and
  • United States: usually 7–10 business days.

These are estimates rather than guaranteed dates. Customs checks, carrier problems, weather, industrial action, and busy periods may cause delays. Your rights when delivery is late are not affected.

US orders use a tracked, duties-paid service. You should not normally be asked to pay more import duties or customs charges when the parcel arrives. Any sales tax collected will be shown at checkout. If a carrier unexpectedly asks for an import payment, please contact us before paying it.

Where reasonably necessary, we may send an order in more than one parcel. We will not charge extra for this unless you agree.

10. Delivery addresses, ownership, and responsibility for goods

You must provide a complete and correct delivery address. Contact us immediately if you notice a mistake.

If the order has not been dispatched, we will try to correct the address. After dispatch, this may not be possible. You may have to pay reasonable recovery or redelivery costs caused by an address error you made. This does not apply if we or the carrier made the mistake.

For consumer orders, we remain responsible for loss or damage until the goods are physically received by you or by someone you chose to receive them. If you separately arrange a carrier that we did not offer, responsibility passes to you when we give the goods to that carrier.

You own the goods after we have received full payment and they have been delivered.

11. Delayed or failed delivery

Please email us if your order does not arrive within the expected timeframe. We will investigate with the carrier.

You may have the right to end the contract immediately if we miss an agreed essential deadline or tell you that we will not deliver. In other cases, you may give us a reasonable further period to deliver and end the contract if we still fail to do so. After a valid cancellation, we will refund any amount due without undue delay.

Events outside our reasonable control may delay an order. We will take reasonable steps to limit the effect, tell you about significant delays, and respect any cancellation or refund rights provided by law.

12. Change-of-mind cancellations and returns

We offer the following standard to consumers in both the United Kingdom and the United States. Any stronger rights provided by applicable law still apply.

You may cancel an eligible order without giving a reason from the time the contract begins until 14 days after the day you, or someone you nominated, receives the goods. If an order arrives in separate deliveries, the period starts after the last item is received.

To cancel, email us with a clear statement that you want to cancel the order. Include your name, order number, contact details, and the products you are cancelling. You do not need to complete a form.

After telling us that you wish to cancel, you must return the goods within another 14 days to:

Please contact us before posting so we can give you practical instructions and identify the return. This request does not take away a statutory cancellation right.

You pay the direct postage cost of a change-of-mind return. We recommend keeping proof of posting and choosing suitable tracking or insurance, as you are responsible for the return until it reaches us.

Sale items have the same change-of-mind rights as full-price items.

You may inspect a product as you could in a physical shop. If you handle it more than needed to check its nature, features, and function, we may reduce the refund by the actual loss in value. Opening packaging does not automatically remove your return right or create a restocking fee. Using or removing stickers may greatly reduce their value.

13. Change-of-mind refunds

After a valid cancellation, we will refund:

  • the price paid for eligible returned products; and
  • for a UK statutory cancellation, the cost of our least expensive standard outbound delivery option. If you chose a more expensive service, we do not have to refund the extra amount.

We will refund you without undue delay and no later than 14 days after the earlier of:

  • the day we receive the goods back; or
  • the day you give us evidence that you sent them back.

We will use the original payment method unless you clearly agree to another method. We do not charge a refund fee.

For a voluntary US return, whether we refund the original delivery cost depends on the offer shown when you ordered and any mandatory US law that applies.

14. Faulty, damaged, incorrect, or missing goods

This is separate from the change-of-mind policy.

Goods must be of satisfactory quality, fit for any purpose you made known to us, and match their description. UK consumers have rights under the Consumer Rights Act 2015. Depending on the problem and when it is reported, these may include rejecting the goods, a repair or replacement, or a price reduction. These Terms do not remove those rights.

If an item is faulty, damaged when it arrives, incorrect, incomplete, or missing, email us promptly. Include your order number and explain the problem. Photographs can help us resolve it, but they are not required for you to keep your legal rights.

If goods do not meet the contract, we will cover reasonable return costs and provide the remedy required by applicable law. Please do not dispose of an affected product before we have had a reasonable chance to advise you, unless keeping it would be unsafe or unreasonable.

US customers keep any warranties and remedies that applicable federal or state law says cannot be excluded.

15. Reviews, photographs, and other customer content

If the Website allows you to submit a review, photograph, comment, or other content (“Customer Content”), you continue to own it.

You give us a non-exclusive, worldwide, royalty-free licence to host, copy, resize, format, display, and share it to run and promote Designing Liefde. This may include using it on our Website, in emails, and on social media. The licence lasts until you ask us to stop future use, except where we reasonably need to keep it for legal records or materials already produced. We will not sell your Customer Content as a separate product.

By submitting Customer Content, you confirm that:

  • you created it or have permission to share it;
  • a review is honest and based on your genuine experience;
  • it does not infringe another person’s rights;
  • it is not unlawful, threatening, abusive, discriminatory, defamatory, obscene, fraudulent, or malicious; and
  • it does not contain malware, spam, hidden advertising, or another person’s private information without permission.

We may refuse, moderate, or remove content for a reasonable reason, including a breach of these rules or a legal requirement. We do not promise to publish every submission, and we will not manipulate reviews in a misleading way.

16. Intellectual property

Unless we say otherwise, the Website and its text, graphics, branding, illustrations, photographs, product designs, and other content are owned by or licensed to Designing Liefde and protected by intellectual-property law.

You may use the Website and save or print order information for personal, non-commercial purposes. Unless the law allows it, you may not copy, change, republish, distribute, sell, license, scrape, or commercially use our content without written permission.

You may not use the Designing Liefde name or branding in a way that falsely suggests our approval, a partnership, or that something came from us.

17. Acceptable use of the Website

You must not use the Website:

  • unlawfully, fraudulently, or to infringe another person’s rights;
  • to submit false, abusive, misleading, or harmful material;
  • to introduce malware or other harmful code;
  • to gain unauthorised access to accounts, systems, or data;
  • to collect personal information unlawfully;
  • to disrupt the Website, its security, or another person’s use of it;
  • to send spam or carry out deceptive activity; or
  • to use scraping or automated tools in a way that causes disruption or breaks the law.

We may suspend access when reasonably needed to protect customers, the Website, or our legal rights. This will not affect rights connected with an order we have accepted.

18. Accounts

If customer accounts are available, you must provide correct information, keep your login details secure, and tell us promptly if you think someone has accessed your account without permission.

We may suspend or close an account because of fraud, unlawful use, a security risk, or a serious breach of these Terms. Closing an account does not remove rights or responsibilities connected with an existing order.

19. Third-party services and links

Shopify provides our ecommerce platform. Payment providers, delivery carriers, review services, and other suppliers may also help us provide our services. Unless we clearly say otherwise, your purchase contract is still with Designing Liefde.

The Website may link to independent third-party websites. We do not control their content, availability, or separate transactions. Please read their terms and privacy information before using them. This section does not remove any responsibility the law places on us for suppliers or subcontractors we use to fulfil your order.

20. Privacy

We handle personal information as explained in our Privacy Policy and under applicable data-protection law. Shopify and other service providers may process information to run the shop, take payments, prevent fraud, deliver orders, and provide requested services.

Marketing is optional. If you subscribe, you may unsubscribe at any time through the link in a message or by contacting us.

21. Our responsibility to consumers

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. A loss is foreseeable if it was clear that it could happen or if both you and we knew it could happen when the contract began.

We sell products for private use. Under these consumer Terms, we are not responsible for business losses caused by commercial use, including lost profit, revenue, business, opportunity, or data.

Nothing in these Terms excludes or limits responsibility where the law does not allow it. This includes responsibility for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of rights concerning the goods, delivery, or transfer of risk that cannot be excluded; or
  • anything else that the law says cannot be excluded or limited.

22. Changes to the Website and these Terms

We may update the Website or these Terms for legal, regulatory, security, operational, or business reasons.

The version shown when you place an order will normally apply to that purchase. A later update will not change an accepted order unless the law requires it or you clearly agree.

The date at the top shows when these Terms were last updated.

23. General terms

If a court or other authority finds part of these Terms unlawful or unenforceable, only the necessary part will be removed. The rest will continue to apply.

If we delay enforcing a right, that does not mean we have given it up.

These Terms, together with the information included in your order, form the agreement between you and us for that order. This does not exclude responsibility for fraud or stop either party relying on statements that legally form part of the contract.

No one other than you and us may enforce these Terms, unless applicable law says otherwise.

24. Governing law and disputes

Please email us first so we can try to resolve a complaint promptly.

These Terms and each contract are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.

If you live elsewhere, including Scotland, Northern Ireland, or the United States, you still keep any mandatory consumer protections and rights to use local courts that would otherwise apply. You may bring a claim in any court available to you under mandatory law.
